is important. Although creative works are automatically
“copyrighted” in the United States when recorded
in a “tangible medium” (i.e., in way that it can
be reproduced), the copyright cannot be enforced
if it has not been registered. Also, failure to register
early prevents the copyright owner from obtaining
attorney fees in litigation from the infringer or
from obtaining “statutory
damages.” Those may be large. Also, it may be
difficult to prove other damages. Without statutory
damages, it may not be practical to enforce the copyright.
