Declaratory Judgment
Actions
When
an owner of intellectual property accuses someone
of infringement, the accused can file a lawsuit
called a “declaratory judgment action.” The benefit to the defendant is
that the lawsuit is filed in a forum the defendant
feels would be better than where the patent owner
might file. There are many other tactical
considerations as well. Owners and accused
infringers should consider this process in development
of an intellectual property strategy (whether it
is for patents, trademarks, copyrights, or trade
secrets).
