Departing Employee
Exit Interviews
When employees leave an organization, having an exit
interview serves a number of purposes. As part of an
employee
secrecy education program,
it reinforces the importance the company puts on its
confidential information, making it less likely there
will be a problem; it gives an opportunity to specifically
identify for the employee what ongoing obligations
there are to the organization – and what limits the
employee has on future employment. If there was an
employment agreement,
it is a good idea to go through the terms the employee
previously accepted. Documenting the exit interview
process also aids in preservation of evidence that
would be needed if there were trade
secret litigation.
It takes experienced attorneys to design an exit interview
process to achieve these goals.
