Employee secrecy education
can address many issues that an organization might
encounter with regard to trade secrets. Employees
do not always understand what information is confidential
and what is not. They may not understand how competitors
will attempt to learn trade secrets from them, either.
Also, the amount of effort an organization puts into
protecting confidential information is an important
element in any trade secret case.
When coupled with an employee handbook that includes
intellectual property policies and well drafted employment
agreements, secrecy education gives the
employees specific guidance – and comfort. It can
also be used in an exit
interview to remind
departing employees of their obligations.
Designing an education program to accurately explain
the employees’ obligations and specifically identify
the amount of confidentiality assigned to various
pieces of information requires experienced lawyers.
