Restraining Orders
Temporary restraining orders
are requested by plaintiffs to prevent defendants
from operating before a preliminary injunction hearing
can occur. Because the grant of such relief is extraordinary,
the temporary restraining order results in a shortened
hearing before a judge (not a jury). There, the issues
are not exactly the same as at trial. The outcome
of this process can cause a fast settlement.
