Trademark rights are established,
in the US, through use of the trademark. Nothing
more is needed to have a "trademarked" product.
A trademark user should begin using the "TM" symbol
with the first use of the brand or logo in conjunction
with the product, to show that trademark rights are
claimed in the brand. However, just because registration
is not necessary does not mean it should not be considered.
There are many procedural and publicity advantages
to be had. Also, in many other countries, the trademark
rights are established by registration in those countries
– not by use.
