USPTO Announces Prioritized Examination Program

HOUSTON, TX. (April 5, 2011)— ARNOLD & KNOBLOCH — On April 4th, the United States Patent and Trademark Office announced the implementation of the “prioritized examination,” a program that provides applicants with greater control over when their applications are examined.

Starting May 4, 2011, applicants may request to have their application placed on the examiner’s “special docket” throughout its entire prosecution—for an extra fee of $4000.  Some who have applications in slow areas of the Office will see this as a good deal.  The goal is to provide the applicant with a final disposition within twelve months of prioritized status being granted.  This program is limited to a maximum of 10,000 applications, at least until the end of this fiscal year.

There are a number of requirements for an application to be allowed this special status, and a significant amount of pre-filing work should be performed to maximize the benefit of prioritized examination.
